CANCELLATION & REFUND POLICY

AGREEMENT TO OUR LEGAL TERMS

We are Project Management Institute Trivandrum Kerala Chapter (doing business as PMI Trivandrum Kerala Chapter) (‘PMI Kerala’, ‘Company’, ‘we’, ‘us’, or ‘our’) with office registered in Thiruvananthapuram, Kerala State, India.  We, as well as any other related products and services that refer or link to us, operate under these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”, “Your”, or “User”), and PMI Kerala, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

CANCELLATION

By customer

You are entitled to request a cancellation of your order within 7 Business days of purchase.  However, as the chargeable services are limited to trainings, your cancellation request must be received at least 2 days prior to the training start date.  Further, the cancellation request will not be entertained if the training material orders have been communicated to the vendors/merchants and they have initiated the process of shipping them.

In order to exercise your right to cancel, you must inform us of your decision through a clear statement along with the relevant proof / information. You can inform us of your decision by email: vp-operations@pmikerala.org

By PMI Kerala

In the event of unforeseen challenges, training scheduled by PMI Kerala may need to be canceled or postponed, PMI Kerala will inform the candidates through an email at least 2 days prior to the training start date.  Registered participants will be given an option to choose to attend the next session of the same training when scheduled, with no other additional costs or opt to claim refund.

REFUND

We offer refunds for services that have not been rendered or completed, or in cases where the service provided did not meet the specifications agreed upon, provided such refund is sought pursuant to cancellation request made.  However, for cancellation of service by customer, you are entitled to receive refund limited to paid amount less the payment gateway and other applicable charges.  For cancellation of service by PMI Kerala, if refund option is chosen, then you are entitled to receive refund of the full amount paid for the service.

Our team will review your request and inform you of our decision within 7 Business days about our decision.  We reserve the right to refuse returns of any purchase that does not meet the return conditions, at our sole discretion.

If your request for a refund is approved, we will reimburse you no later than 45 days from the day your request is approved.

We will use the same means of payment that you used for your order, and we will inform you of the details of your return, including any applicable charges.

Exclusions

We do not offer refunds in the following cases:

  • If the service has been fully rendered or completed.
  • If the service did meet the agreed-upon specifications but you changed your mind
  • If the refund request is made more than 7 Business days after the purchase / less than 2 days prior to training start date.
  • If the request does not contain the documentation as requested.
  • In case of force majeure cases (such as curfew, riots etc), we shall not be liable for any losses made thereof.  Circumstances amounting to “force majeure” include any event which we could not, even with all due care, foresee or forestall such as (by way of example and not by way of limitation) war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, acts of God, adverse weather conditions, and all similar events.

Escalations

If 45 days have passed since the approval of your refund request, and you are yet to receive your refund, you can reach out to president@pmikerala.org as the designated point of escalation for your concern.

GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of India and you irrevocably consent that the courts of Trivandrum, Kerala shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

This policy is superseded by the ‘Terms of Use Policy’ issued by the ‘Project Management Institute’ (www.pmi.org). In the event of any conflict or inconsistency between this policy and the superseding policy, the provisions of the superseding policy shall govern.
